The South Korean flag is banned in North Korea.
The American flag is banned in North Korea.
The Israeli flag is banned in several nations.
Pakistans flag falls under the “Prevention of Insults to National Honour Act” in India.
The Indian flag falls under pakistans flag rules.
Should all those flags be removed?

It‘s not the same, although mainland China no longer recognizes it as the national flag, it is not prohibited to the same extent as the swastika. The flag may be politically sensitive in some situations, but displaying it is not inherently illegal.

using it to represent the china post 1949, or to push the roc as a independent nation is illegal

And I don’t see any issue with adding the ROC flag, unless we label it as ‘ROC 1912–present’ or ‘ROC(Taiwan).’ Simply calling it ‘China’ wouldn’t carry any of those implications.

And in game it would represent the ROC as part of a united Chinese techtree. That doesn’t seem illegal.
As for using it past 1949, that’s where I’d say a regional censor for PRC players might be used to simply change the flag to PRC flag.
Then it would only show for everyone outside of the specific nation it’s banned in, since unlike the Swastika which is banned in many nations, this is an issue specific to one nation only and can easily be resolved this way.

Because German WW2 existed in the past, not in the present. If modern RoC doesnt exists, modern RoC vehicles shouldnt be added, as its not a nation. Its like adding >insert islamic radical group flavour< vehicles to the game.
